1. Acceptance of Terms

By accessing, browsing, or registering on JobGround (“the Website”), or by purchasing any advertising service (“the Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“T&Cs”) and our Privacy Policy. If you do not agree, you must cease use of the Services immediately. (br>

2. Services Provided

JobGround provides an online platform that facilitates the connection between:

    • Employers/Recruiters who post job vacancies (“Job Listings”).
    • Job Seekers/Candidates who search for and apply to Job Listings, and create candidate profiles (“Candidate Profiles”).

JobGround acts strictly as a platform and is not a recruitment agency, temporary employment service, or employer of any candidate.

3. User Obligations and Prohibited Content

a. For Employers/Recruiters (The Client)

    • Compliance: You warrant that all Job Listings comply with all applicable South African legislation, including, but not limited to, the Labour Relations Act, the Basic Conditions of Employment Act, and the Employment Equity Act. Discriminatory practices based on race, gender, religion, or any other protected grounds are strictly prohibited.
    • Genuine Vacancies: Job Listings must be for genuine, currently available employment positions. You may not post advertisements for Multi-level marketing (MLM), pyramid schemes, jobs requiring an upfront fee, or advertisements solely for data collection.
    • Content Vetting and Publication: All Job Listings submitted by the Client are subject to mandatory review and approval by JobGround staff before being published. This is conducted to ensure compliance with South African employment law, prevent fraudulent activities, and maintain content quality. JobGround reserves the right to reject or request amendments to any listing.
    • Content Accuracy: You are solely responsible for the content and accuracy of your Job Listings. JobGround reserves the right to remove any listing deemed misleading, inappropriate, or in violation of these T&Cs, without notice or refund.
    • POPIA Compliance & Data Ownership: Upon receiving a candidate’s CV or personal information through the platform, the Client (Employer) becomes an independent “Responsible Party” for that data under POPIA. The Client agrees to process such data solely for recruitment purposes related to the specific role advertised and must delete the data if the candidate is not hired, unless a lawful retention period applies.
    • Employment Equity: The Client is solely responsible for ensuring that Job Listings and hiring practices comply with the Employment Equity Amendment Act and any applicable sector-specific targets.

b. For Job Seekers / Candidates

    • Profile Accuracy: You must provide truthful and accurate information when creating a Candidate Profile or submitting an application.
    • Use of Data: You agree that your profile and application data may be viewed by registered Employers/Recruiters for the purpose of recruitment.

c. Prohibited Content

Users are strictly forbidden from uploading, posting, or transmitting any inappropriate content, including but not limited to:

    • Inappropriate Photos or Profile Images: Content that is sexually explicit, graphic, violent, or discriminatory.
    • Inappropriate Comments or Messages: Harassing, abusive, defamatory, or hateful commentary directed at other users or the platform.
    • Fraudulent or Illegal Documents: Posting or submitting documents (CVs, certifications, etc.) that are forged, misleading, or related to illegal activity.

d. Site Monitoring and Verification

JobGround reserves the right to monitor and manually check user profiles, job listings, and uploaded documents to ensure the site remains legitimate, professional, and scam-free. This includes verifying the content posted and the identity or credentials of users where necessary.

e. Consequence of Violation

If JobGround, in its sole discretion, determines that a user has uploaded inappropriate photos, comments, or documents, or is engaged in any scam-related activity, the user’s account will be immediately deleted and permanently banned from the Website, and any purchased Services will be forfeited without refund. JobGround bears no responsibility for the content uploaded by users, but will take immediate action upon discovery or report of a violation. JobGround reserves the right to suspend or restrict access to accounts pending investigation of suspected violations.

4. Direct Contact Disclaimer

JobGround may provide a “WhatsApp” button or display mobile numbers to facilitate quick communication. You acknowledge that conversations occurring on WhatsApp, SMS, or phone calls happen off-platform. JobGround does not monitor, record, or control these interactions. Users engage in off-platform communication at their own risk. Employers who contact candidates via WhatsApp, SMS, or phone act as independent responsible parties and are responsible for their own compliance with applicable data protection and employment laws.

5. Payments, Cancellations, and No-Refund Policy

    • Pricing: All prices for Job Listings and advertising packages are quoted in South African Rand (ZAR) and are subject to change without prior notice.
    • No-Refund Policy: Due to the immediate nature of the Services, once a Job Listing has been submitted and published (made visible to the public or Candidates), the service is deemed rendered, and all payments are non-refundable.
    • Full Refund Exception: A full refund will only be considered if the job listing package was purchased, but the job post was not yet published and was canceled prior to activation.

6. Statutory Cooling-Off Period

In accordance with the Electronic Communications and Transactions (ECT) Act, you are entitled to a 7-day cooling-off period only if the service has not commenced. Once a Job Listing is approved and published, the service is considered “rendered,” and the cooling-off period no longer applies.

7. Limitation of Liability and Disclaimer

    • User Due Diligence: While JobGround performs basic vetting of listings, we do not verify the physical premises or the legal status of every employer. Candidates are strongly advised to perform their own due diligence. JobGround is not liable for any financial loss or personal harm resulting from “Job Scams,” including but not limited to, users requesting “application fees” or “clearance fees,” which are strictly prohibited on our platform.
    • Disclaimer of Warranty: The Services and the Website are provided on an “as is” and “as available” basis. JobGround makes no warranties, express or implied, regarding the effectiveness of a Job Listing or the suitability of a Candidate.
    • No Liability for Outcomes: JobGround is not responsible for any hiring decisions made by the Client, the conduct of any Candidate, or any loss, damages, or costs incurred by either party as a result of using the Services.
    • Maximum Liability: JobGround’s total liability to the Client shall be strictly limited to the amount paid by the Client for the specific Job Listing or service that gave rise to the claim.

8. Indemnity

You agree to indemnify and hold JobGround, its directors, employees, and agents harmless from any claim, demand, damages, or losses, including reasonable legal fees, arising out of your breach of these T&Cs or your use of the Services, including any third-party claims arising from inaccurate or illegal content posted by you.

9. Intellectual Property

All content, logos (including the JobGround logo), trademarks, software, and intellectual property on the Website are owned by or licensed to JobGround and are protected by South African and international intellectual property laws.

10. Legal Compliance

Employers must ensure that candidates they hire meet the applicable statutory requirements for employment in South Africa. In terms of the Basic Conditions of Employment Act, persons under the age of 15 years may not be employed, and persons aged 15 to 17 years may only be employed in work appropriate for their age and schooling obligations.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.
